TERMS AND CONDITIONS
These Booking Conditions, together with our Privacy Policy and where your tour is booked via our website, together with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with Voyages Hub Tours Inc. (“we”, “us”, “our”). Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.
By making a booking, the first named person on the booking (“Lead Name”) agrees on behalf of themselves and all persons detailed on the booking that:
DEPOSIT
Guaranteed deposit at time of booking. Sorry, but this deposit is NON-REFUNDABLE. Insurance, which is strongly recommended, must be purchased at time of deposit. Deposit is $500 per person for all destinations, except for Africa, which is $750 per person.
For Sun destinations, full payment is due for online bookings made within 45 days of departure. Bookings outside of 45 days may be permitted to apply a deposit based on the third party supplier terms and conditions.
There may be certain tours and arrangements which will require a higher deposit. The exact amount will be advised at the time of booking. In addition to the deposit, we require full payment for the air portion in order to issue airline tickets and guarantee the fare. It is recommended that we receive confirmation on land prior to issuing airline tickets.
BALANCE OF PAYMENT
Guaranteed balance of payment is required Sixty (60) days prior to departure, except for Africa, which is 3 months (90 days), prior to departure.
If the balance is not paid by the stipulated date, the right is reserved to cancel the booking(s) without further notice and without refund of deposit.
CREDIT CARD POLICY
Voyages Hub accepts MasterCard, Visa and American Express credit cards and when paying with any of these credit cards Voyages Hub Travel will appear as the vendor on your credit card statement. By authorizing the use your credit card to pay for the travel services provided by Voyages Hub you are accepting these Terms and Conditions. By providing Voyages Hub with authorization to use your credit card you are confirming that you will pay the total amount charged for those services to the card issuer in accordance with your cardholder agreement. If the credit card holder is not one of the people travelling, a Credit Card verification process will be required, including the completion of a Third-Party Credit Card Form and presentation of two pieces of government issued identification.
TRANSACTION FEE
Occasionally banks will charge their customers a fee for making a payment in a different currency, or to a business in another country. This fee is not something that Voyages Hub, or our Bank or our Merchant Service provider applies, and instead it is completely down to the customer’s bank. To learn learn more about why the extra fee was charged, cardholder will need to reach out to their bank directly and clarify about it.
If You Cancel Your Package Booking Before Departure
You may cancel the booking at any time provided that the cancellation is communicated to us in writing. Your notice of cancellation will only take effect when it is received in writing by us and will be effective from the date on which we receive it.
Should one or more member of a party cancel, it may increase the per person holiday price of those still travelling and you will be liable to pay this increase.
Since we incur costs in cancelling your arrangements, cancellation charges will be applied as shown below calculated from the day when written notice is received by us. The more notice that we receive, the less we will charge you. However, in addition to the charges shown below many air tickets have no refund value whatsoever and, therefore, airlines may impose 100% cancellation charges and the cost of a new ticket. Cancellation charges apply as follows:
CANCELLATIONS
Cancellations received prior to final payment will incur loss of non-refundable deposit.
After the final balance is paid, the following cancellation schedule will apply:

| Sun Destinations | Once booked, Cancellations and/or changes may result in a 100% penalty. Some changes may be permitted, for a fee, as per Terms and Conditions of the Tour operator, airline or consolidator, administration fees will apply. A written request may be required for any changes to a reservation. No refund will be made for unused travel services or any unused portion of the services. Any changes to your booking are subject to the Terms and Conditions of the tour operator and airline. |
Other specific supplier and airline cancellation penalties may apply in addition to above cancellation and amendment fees charged by Voyages Hub. There will be no refund for unused land arrangements. All cancellations required in writing.
INCLUDED IN YOUR VACATION PRICING
Unless otherwise noted, the price of your holiday includes what is referred to “the price includes” with respect to each holiday. All features provided by the cruise line or hotel (complimentary or not), are set out on each cruise/hotel page. All hotel information was provided by the applicable hotel management and any features that are temporarily unavailable or which have been permanently withdrawn – for whatever reason – do not have any cash value and are non-refundable. Any features can be changed by a cruise line, hotel or Voyages Hub, with or without prior notice.
NOT INCLUDED IN YOUR VACATION PRICING
Items not included in your package holiday include, entry and exit fees, entry visas, passports, health certificates, laundry and dry cleaning, some a la carte restaurants, meals and alcoholic beverages not mentioned in itineraries, casino, medical services, excursions, telephone calls, internet access, faxes, spa and salon services, safe, mini-bar, tips, onboard gratuities/tips (mandatory gratuity is added to all beverages purchased onboard) , resort fees, City Taxes, and certain baggage charges.
TOUR CANCELLATIONS BY VOYAGES HUB TOURS INC.
The company reserves the right to cancel any trip in its sole discretion. In the event that a tour is cancelled, Voyages Hub Tours Inc. shall have no responsibility beyond the refund of all monies paid by the Passenger which shall be deemed to constitute full settlement. Voyages Hub Tours Inc. cannot guarantee weather conditions nor can Voyages Hub Tours Inc. be responsible for any shutdowns, whether wholly or partially of the operations of any services in connect with the trip whether they be caused by weather or for any reason or cause.
BOOKING CHANGES & CANCELLATION
Correction of a name, change of name, change of a departure date or change of the type of tour, is possible if accepted by the supplier but subject to the applicable fee. Changing all names on a the reservation constitutes a cancellation. If rooming requirements are altered due to a cancellation by one or more passengers, the passengers still travelling must pay the applicable rate for the accommodation to be occupied. Once travel has commenced, no changes to the booking are permitted.
The vacation packages are prepared months in advance, and sometimes one of the advertised services or locations is modified or not available. On occasion after your booking is confirmed, we may have to make changes to the services that are part of the package. Most often this will be minor, however we may have to make a Major Change before you depart. Major Change includes:
If we have to make a Major Change, we will advise you and you may:
– accept the change;
– select one of our alternate vacation packages at the applicable price; or
– cancel completely and obtain a full refund of the price you paid.
Sometimes the hotel featured on the itinerary may not be available because of unexpected maintenance or overbooking. If this is the case, Voyages Hub will provide a substitute hotel, of equal or greater standard. If Voyages Hub is obliged to downgrade the accommodation, and you accept that offered change, Voyages Hub will provide you with a partial refund. We reserve the right to change our published prices without notice and to pass on to you all government imposed taxes, transportation fees and surcharges, including fuel and currency fluctuations.
REFUND
Voyages Hub may not be able to refund you in full for changes that are made for reasons of Force Majeure, namely war or threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, weather causing beach erosion, epidemics or health risks, technical or mechanical problems with transport, flight delays due to weather, government action, closed or congested airports or seaports, supplier insolvency and any events beyond our control.
Accuracy
We endeavor to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate, however occasionally changes and errors occur, and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before you make your booking.
INSURANCE
At Voyages Hub we believe that your safety and enjoyment are the most important parts of your holiday. Travel insurance is therefore mandatory whenever you travel.
Before you join your tour you should be covered by insurance that includes adequate coverage for baggage, medical expenses and the cost of repatriation should you become too ill to continue to travel. In addition to this, we strongly recommend that you include coverage for tour cancellation in the event that you must cancel your reservation prior to departure because of serious illness or injury to yourself, a member of your immediate family or travelling companions.
FORCE MAJEURE
Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control.
Pandemic Implications: please note that certain overseas travel arrangements may be affected as a result of the Pandemics. This could include an unavailability of certain flight routes, access to certain ports and airports etc. Please rest assured that this is something we will continue to monitor and will advise our customers as soon as possible if we become aware of any confirmed bookings that will be affected. However, since this is something which is completely unprecedented and outside our control, we would treat any such changes as Force Majeure, and whilst we will endeavour to provide suitable alternative arrangements or credits or refunds where possible, we will not be liable to pay you any compensation..
TRAVEL DOCUMENTS
Travel documents and tickets, joining and departure details, supplier addresses and phone contacts will be sent upon receipt of final payment. Airline tickets contain conditions as well as the terms of carriage. Please read these conditions carefully as they affect your legal rights
Passports/VISAS
It is your responsibility to check and fulfill the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change, please ensure your information is up to date.
If your passport is in its final year, you should check with the Embassy of the country you are visiting. For further information contact the Passport Office
Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Most countries now require passports to be valid for at least 6 months after your return date. Some countries require a full blank page in the passport for stamping purposes. Any information provided pertains to US & Canada citizens only. Non-US & Canada citizens should check with the respective consulate of the country(s) to be visited for current entry requirements.
PRICES
Prices are in U.S. /Canadian Dollars (as specified) based on costs at the time of posting. Prices depend on numerous factors including, fuel and exchange rates.
Prices are per person based upon shared twin room occupancy. Prices do not include items of a personal nature such as laundry, wines, water, beverages, food other than the table d’hote menu, passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly. In case of human or computer error, If any of the costs increase, Voyages Hub may increase the price of any item. Voyages Hub reserves the right to increase or decrease prices and will make all efforts to advise of price increases at least 15 days prior to departure date. Voyages Hub reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase, provided Voyages hub receives a written cancellation within five days of the price increase notification.
Children
All children under 18 must be accompanied by an adult. There is no minimum age on independent packages. Discounts for children sharing a room as third may apply to children under 12. Most hotels do not permit children under 18 to occupy a room without an adult. Accompanying adults are responsible for the safety of their children including to provide any necessary safety equipment (such as infant/child seats) where appropriate. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non-travelling parent, granting authorization to travel, including the dates of travel should be carried.
AMENDMENT FEES
Changes to an existing reservation up to the Final Payment Date, whatever the cause, will incur a $50 per person change fee, potential loss of any supplier fees (such as non-refundable event tickets, park permits reservations) plus any costs for replacement services. On/ after the Final Payment Date, the $50 change fee is no longer valid, instead cancellations terms apply. This includes name changes* and removal of any services such as optional tours and transfers. *Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.
REFUNDS FOR UNUSED TRAVEL SERVICES
Under no circumstances is Voyages Hub is obliged to provide you with a refund for unused travel services or any portion thereof.
Online bookings:
Auto-generated e-mails are sent immediately after payment is made to confirm payment has been received. Online bookings are not confirmed until a personalized e-mail detailing that a booking is confirmed is sent by a member of our reservation team.
Airline Booking
Voyages Hub offers a choice of airlines and airfares for your convenience, but is not responsible for the services and policies imposed by the airline selected. Airline schedules and flights are subject to change without notice. Voyages hub is not responsible for penalties incurred for tickets, international or domestic, not issued by Voyages hub due to schedule and/or flight changes.
Do not book flights until you have received a personalized confirmation email from our reservations team which will be within 24 hours of receiving your online booking. We endeavor to display accurate availability on our website, though on rare occasions online bookings are made concurrently with others and our website can not reflect this information
Airline Contact Information: Pursuant to Airline regulations, passengers are responsible to provide Voyages hub with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, email and fax data for all passengers. Passengers must ensure that names are correctly listed on their invoice. Voyages hub will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information.
Airline Name Changes: Any name change including minor spelling corrections may require airline reservations to be cancelled and re-booked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $50 revision fee per change. Voyages Hub will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing.
Airline Taxes & Surcharges: If you purchased airfare, airline taxes and surcharges are included. Prior to completion of full payment there is a potential for a price increase(s) due to increases in government-levied taxes and fees and/or increased surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are fully non-refundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes will be indicated in our final documents
Airline Tickets: Once full payment is received, airline tickets will be issued and are fully non-refundable. Should airline tickets require to be issued earlier than the Final Payment Due date, you may be required to pay a larger non-refundable deposit and/or complete full payment. Once issued, some Published Instant Purchase Airfare tickets may be changed prior to the departure date and the airfare applied toward travel within 12 months of the original date of issue for a fee of $200 or more plus any difference in airfare; however, some tickets are non-changeable; specific fees and policies may vary by airline. Please note that some airlines do not accept all major credit cards for payment of Published Instant Purchase Airfare.
Airline Seat Assignments: As a courtesy service, airline seat assignments are requested on your behalf and are displayed in order of Passenger #1, #2 and so on. Assignments reflect the best available seats at the time of booking. Some airlines and/or fare types do not allow for pre-seating and require this be done at airport check-in only; in this case, the display shows “N/A”. Seats are subject to change by your airline(s) including, for example, when there is a schedule change or equipment change after your initial booking; this may cause seat assignments to be changed or even cancelled. In the event that you change seat assignments directly with your airline, changes will not be reflected on this display. At the time that Voyages hub documents are issued, the currently assigned seats will be listed based on the assignments stored in your airline reservation at that time. Airline Frequent Flier Programs: Passengers are responsible to contact their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether to award miles in part or total based on their own rules which are updated frequently. Some discounted or promotional airfares as well as some code-share flights are not eligible for mileage accrual. Some private airfares, such as a “Voyages Hub Airfare”, are not eligible for mileage or may qualify for reduced mileage, even if the same airline class of service is eligible for full mileage when sold as an “Instant Purchase” published airfare. Not all published airfares are eligible for mileage. Voyages hub will record frequent flier numbers when provided by the passenger prior to travel documents being issued. However, the addition of frequent flier numbers to airline records does not guarantee mileage eligibility which is at the sole discretion of each airline. Airline schedule changes may result in flights which were originally eligible for mileage accrual no longer being eligible. We highly recommend passengers to provide their frequent flier account information whenever checking in online and/or at the airport check-in desk. After travel has commenced, it is often not possible to apply for frequent mileage credit. Passengers are also responsible to determine whether previously earned mileage may be applied to flights to secure upgrades.
Airline Schedule Changes: In the event of an airline schedule change, Voyages Hub will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. Voyages Hub is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. Voyages Hub is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passenger’s responsibility to advise Voyages Hub of amended flight details in writing. Voyages Hub cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge.
Airline Baggage: Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26″+26″+10″ = 62”), and a maximum weight of 50 lbs (23kg). Smart Bags with a USB charging port, GPS tracking device and other high-tech features are prohibited as checked or carry-on baggage unless the bag is made with removable batteries and the batteries are removed and stored separately. For specific requirements of your airline and for a complete list of fees, please visit individual airline website for more information. Many airlines apply charges for checked bags including flights which begin and end within the USA. Voyages Hub avoids the most inexpensive airfare options commonly known as Basic Economy airfares which typically do not include any checked bags nor seat assignments before the day of departure. However, for some airlines, other airfare categories also do not include checked baggage. This will be clearly displayed in our airfare selection and on your invoice. Where available, we highly recommend selecting airfares which include at least 1 piece of checked baggage. Voyages hub is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. Checked baggage allowances displayed on reservation details and invoices reflect the applicable allowance at the time of booking but are subject to change by your airline(s). If your luggage is lost or damaged by the airlines, a baggage claim form must be filed with the carrier before leaving the airport
Hotel Accommodations
ROOM OCCUPANCY POLICY

Advertised prices are based on maximum occupancy. Rooms may consist of any combination of the following, based on occupancy: one king sized bed, one queen sized bed, one double sized bed, two queen sized beds, two double beds, a pull-out couch, a roll-away bed or a single bed. Upon booking the Trip, should you not provide the names of desired roommates, Voyages Hub Tours Inc. may match you with other passengers based on the chosen occupancy. Voyages Hub Tours Inc. is not in any way liable for injury, loss or damage as a result of roommate matching. Single and double room upgrades are available at an additional cost.
All rooms are standard King or Queen or twin-bedded (two single beds) rooms with private facilities, unless you have specifically requested and paid for an upgraded room category. Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel’s management on a run-of-house basis. Special requests such as bed types, smoking preference and connecting rooms are subject to availability. Triple rooms consist of standard twin beds or one double bed plus a sofa/folding bed or cot for third person except in the U.S. and Canada, where triple rooms often consist of two double/queen beds for three persons; a fee may be charged by the hotel for the addition of a cot/rollaway. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. Although available at most 4 and 5 star hotels, use of air-conditioning abroad differs greatly from the United States. Many European and Canadian hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are based on Voyages Hub agreements with its suppliers and are not negotiable. Hotel check-in time is generally not before 4:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late night flight is being used. If a day room is included in the itinerary, check-out will normally be 6:00 p.m. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.
Transfers:
Transfers are provided as indicated for each tour by car, minibus, or motor coach provided airfare is purchased from Voyages Hub. If you purchase a land-only tour, or if you deviate from the arrival and/or departure dates as stated in the itinerary, you will have the option to add transfer services to your reservation. Your arrival transfer is guaranteed for up to one hour from your scheduled arrival time in order to compensate for minor delays. Voyages hub or the transfer company will not be responsible for flight delays, for any reason, beyond one hour from your originally scheduled arrival time. In case of a delay, whether due to flight delay, immigration and customs, or time spent reporting baggage damage or loss, it will be your responsibility to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses will be your responsibility. The cost of a transfer is more expensive than hiring a taxi, as a Voyages Hub transfer necessarily includes round trip service, or ‘dead-leg’, meaning that our driver must come to the airport, hotel or pier only to pick you up and necessarily loses a one-way fare. Often the places of call (airports, seaports, hotels) demand entrance and parking fees, where drivers may have to wait for up to an hour. Voyages Hub transfer drivers, while not employees of Voyages Hub, are reliable and work year-round for Voyages Hub clients. They provide you with a full welcome service, transfer you to the correct location and are prepared to answer your questions along your ride. Passengers comfortable hiring a taxi on their own and do not require assistance will save money.
OPTIONAL TOURS, EXCURSIONS AND ACTIVITIES
Any optional tour or physical activity you undertake at the destination contains a risk of personal injury, loss or damage to you and/or your personal possessions. You agree as part of your agreement with Voyages Hub to assume the entire risk of any and all such injury, loss or damage which you may suffer during or arising out of your participation in any optional tour or physical activity, however it may be caused. Voyages Hub makes arrangements with independent third parties to provide services in connection with the optional tours and physical activities. Voyages Hub exercises great care in choosing these independent third parties but does not have control over them and, therefore, is not responsible for, nor can be held liable for, any acts or omissions or negligence of these independent third parties, their employees, servants, agents or subcontractors. These independent third parties are not agents or employees of Voyages Hub despite their use of any signage or clothing which may contain the name “Voyages Hub” or other related trade names or logos. The optional tours and physical activities are subject to conditions and limitations imposed by the independent third parties and the laws of the country in which they operate. You agree as part of your agreement with Voyages Hub to release, discharge and indemnify Voyages Hub from any and all liability or claims of any nature arising out of or in relation to any loss, damage, injury or illness whether physical or mental, resulting from any delay, substitution of equipment, or any act, omission or negligence of the independent third parties, their employees, servants, agents and subcontractors resulting from or arising out of any of the optional tours or physical activities. Before participating in any optional tour or physical activity you may be required to sign a written release forever releasing, discharging and indemnifying Voyages Hub from any and all claims of any nature arising out of or related to any such optional tours or physical activity
ASSISTANCE WHILE ON YOUR VACATION
Our Voyages Hub representatives are stationed in most destinations to offer assistance and liase with the service providers to resolve any problems during your stay. Any problem must be brought to the service provider’s attention or the Voyages Hub Representative’s attention immediately so that they can work to ensure that you have an enjoyable holiday. It is very important that you bring any problem to the service provider’s attention immediately so that it has the opportunity to rectify the problem. Please note that your failure to report your concerns may preclude your right to a claim.
CONDITIONS IN DESTINATION
Voyages Hub endeavours to keep you up-to-date regarding conditions in your destination, including travel document requirements and travel advisories, but it cannot guarantee the information. Please therefore visit http://travel.gc.ca/travelling/advisories for Canadians and https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/ for U.S. Citizens before departure so that you are aware of any relevant travel advisories before finalizing your travel plans. It is your responsibility to comply with the customs, rules and laws of the country you visit. If you conduct yourself in a threatening manner, Voyages Hub, and any service provider may refuse you service or expel you from the premises. In such circumstances you will be responsible for all costs arising out of your expulsion and you will not receive a refund for any unused portion of your vacation.
PASSENGER RESPONSIBILITY
Trip members assume responsibility to select a trip most appropriate to their physical abilities and may be required to obtain a physician’s release. Members are also responsible for studying pre-departure information; for bringing all necessary equipment and clothing, and must abide by the authority of our Tour Leaders and/or local agents and guides. We reserve the right to refuse the application of anyone and/or expel any tour member whose conduct is incompatible with the interest and well being of other tour participants. Any costs associated with removal will be borne by the passenger.
RELEASE FROM LIABILITY
Voyages Hub, and/or its agents, act only as agents for the client in all matters pertaining to travel. They assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor or other conveyances which may be used, either wholly or in part, in the performance of its duty to the passenger; neither will it be responsible for any act, error, or omission, or any injury, loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle or through the neglect or default of any company or person engaged in conveying the passenger; or for any hotel proprietor, or hotel service, or for any other person engaged in carrying out the purpose for which tickets or coupons are issued. In the event that it becomes necessary or advisable for the comfort or well being of the passengers, or for any reason whatsoever, to alter the itinerary or arrangements, such alterations may be made without penalty to the operators. Additional expenses, if any, shall be borne by the passengers, conversely refund will be made to the passengers if any saving is effected thereby. The Airlines concerned are not to be held responsible for any act, omission, or event, during the time passengers are not on board their planes or conveyance. The passage contract in use by the Airlines concerned, when issued, shall constitute the sole contract between the Airlines and the purchaser of these tours and/or passenger. The right is reserved to withdraw any or all tours should conditions warrant, also to decline to accept or retain any passengers as members of the tours. Voyages Hub or agent can assume no responsibility for lost tickets or coupons.
Voyages Hub, its owners, employees and affiliates, (collectively “Voyages Hub”) does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. Independent contractors may utilize the Voyages Hub logo on signage solely for identification purposes which does not signify Voyages Hub ownership, management or control. As a result, Voyages Hub is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, Voyages Hub is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, diseases and dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics other natural disaster, infectious disease, including, but not limited to, Novel Coronavirus (i.e. COVID-19), and any related quarantine or the threat thereof or for any other cause beyond the direct control of Voyagers Hub. In addition, I release Voyages Hub from its own negligence and assume all risk thereof. This agreement shall serve as a release for you, your heirs, administrators, executors and for all members of your family including any minors accompanying you. Trip members grant Voyages Hub Tours Inc. express permission to take a photographic record of its trips for promotional and commercial use.
ASSUMPTION OF RISK
You are aware that travel such as that You are undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Voyages Hub, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. You are aware that weather conditions may be severe, adverse and/or unpleasant. You are also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which You are participating on the trip. In order to partake of the enjoyment and excitement of this trip you are willing to accept the risks and uncertainty involved as being an integral part of my adventure. You hereby accept and assume full responsibility for any and all risks of illness, injury or death and release Voyages Hub from claims of third party negligence.
You understand the physical requirements of the activity in which you will be participating, and currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and You are willing to assume all risks that may be created, directly or indirectly, by any such condition.
LIMITATION OF VOYAGES HUB’S LIABILITY
Voyages Hub’s liability for any loss, damage or injury, whether to property, physical or mental, arising from its own acts, omissions or negligence, is limited to the amount you paid to Voyages Hub for the services in relation to which you are making a claim.
INDEMNIFICATION OF VOYAGES HUB
You agree to indemnify and save Voyages Hub harmless against any liability, actions (including legal fees), claims, losses, costs and damages, which Voyages Hub may incur, sustain or pay arising out of or in connection with your negligent or intentional act or omission, in relation to any incident alleged to have occurred in destination and/or in relation to services provided by Voyages Hub.
APPLICATION
These Terms and Conditions are binding on all travellers in your party and on each of their estates, heirs, successors and legal personal representatives.
APPLICABLE LAW AND FORUM FOR DISPUTES
Your contract with Voyages Hub is governed by and construed in accordance with the laws of the Province in which you reside and the laws of Canada applicable therein. Any claim or action against Voyages Hub shall be filed in the courts of the Province in which you reside and you agree to attorn to the exclusive jurisdiction of such courts.
SEVERABILITY
